Questions & Answers

THE QUESTIONS MOST COMMONLY ASKED ABOUT PERSONAL INJURY CASES

Q. How Can I Tell If I Have A Case?

A. First, come to Gendlin & Liverman office for a no-cost, no-obligation meeting. We will decide to take your case only if we honestly believe you have a right to damages.

Not until after a thorough investigation will any good lawyer tell you whether you have a case. If we believe you do, we will then use our best efforts to get you all of the money you have coming.

Q. How Long Will It Take To Settle My Case?

A. The length of time it takes to settle each case depends upon its own unique facts and circumstances. A lawyer should not try to settle your case prior to obtaining all the facts concerning injuries and damages you have suffered. Once those facts have been determined, we will use our best efforts to settle your case as quickly as possible.

Q. How Much Money Will I Get?

A. That depends on a number of factors, the most important being your physical and emotional injuries. Lost wages and other factors will also be considered. Once we have determined the full extent of your losses we will evaluate your case based upon our extensive past experience. No settlement will be made without your consent.

Q. What If The Other Person Does Not Have Insurance?

A. In some cases, other insurance will compensate you for your injuries and damages. When we meet with you, we will discuss this possibility.

Q. What Does My Lawyer Need To Know About My Accident And Injuries?

A. Everything! In order to properly evaluate your claim, your lawyer must know everything about your accident and the injuries you have suffered. Your lawyer will need to know the names of all witnesses. He will also need to know about any prior accidents or injuries you have had. Give your lawyer every bit of information so he can use his skills and experience to provide you with the best possible legal advice.

Q. What Should I Do About My Medical Bills and Car Repair?

A. We feel it is usually best to have your medical bills and car repair expenses paid by your own insurance companies. We will discuss these matters thoroughly with you and then advice you as to how you should proceed.

Q. My Doctor Does Not Want To Treat Accident Victims. What Should I Do?

A. Your health should be your first and most important concern. If you doctor will not treat you or refer you to someone who will give you proper health care, we will assist you in finding a competent and caring physician with the appropriate skill and background to give you the best medical care possible.

Q. Can I Get Some Money While I Am Waiting For My Case To Be Settled?

A. Lawyers may advance costs for obtaining medical records and other expenses directly related to the investigation and processing of your claim. However, it is absolutely improper for any lawyer to advance money to a client for living expenses, medical bills, repairs, etc. Any lawyer who makes such financial advances is violating the rules of the Wisconsin Supreme Court governing the conduct of attorneys.

Q. What Will My Legal Fees Be?

A. Gendlin & Liverman clients in injury cases pay no legal fees unless they receive a settlement in their case, and then they pay only a percentage of the settlement*.

There are usually some costs incurred in addition to legal fees. We will explain these to you at your first visit.

*Fee arrangement providing for hourly charges is also available.

Q. When Should I Go Back To Work?

A. You should make every effort to return to work as soon as you are able. That decision rests with you and your physician.

Q. How Should I Choose A Lawyer?

A. In choosing a lawyer to represent you in your personal injury case, look for someone with experience. Injury cases usually involve difficult negotiations. Gendlin & Liverman many years of collective experience is reflected in a tough and smart approach to every one of our clients’ cases. This means that most of the cases we handle are settled without going to court.
